Re: IUOE Local 793 2020 Nomination and Election Update

I am writing further to my letter dated April 9, 2020 with a further update on behalf of the IUOE Local 793 Election Committee (“Election Committee”).

The COVID-19 pandemic continues to be a fluid situation. As of today, there is no sense of when Local 793 will be permitted to hold regular monthly meetings in the normal course.

In recognition of the fact that the only step in the election process which requires in-person attendance is the nomination of candidates as all other aspects are done via mail-in ballot, the Election Committee has sought further advice from our International in Washington and General President Callahan to allow the election to move forward. The enclosed Notice provides the modified election schedule.

It is important to note that nominations will be held in the month of June on the dates when regularly scheduled monthly meetings would have occurred in each district. We have outlined a procedure in the attached Notice to ensure that nominations can be made in person but in a safe manner that takes every reasonable precaution to protect against COVID-19.

We are confident that allowing the nominations to move forward in the month of June in the manner outlined herein is the right decision in order to avoid delaying the election unnecessarily.

2020 ELECTION RULES AND PROCEDURES FOR LOCAL 793 OF THE INTERNATIONAL UNION OF OPERATING ENGINEERS

This is an election year for the members of Local 793, and all of the correspondence on this important issue should be read carefully.

Due to the COVID-19 pandemic, which has resulted in the closure of many businesses and a prohibition on group gatherings or meetings, Local 793 remains unable to hold regular monthly membership meetings at this time.

Normally, nominations would be made during regular monthly meetings in the month of May. We recognize that because of COVID-19, we cannot comply with every constitutional requirement if we are to proceed with the election.

However, in consultation with IUOE General President Callahan, to the extent the following procedure departs from the Constitution, the General President has used his executive power to allow a modification to the rules to allow elections to move forward in the manner proposed herein.

Rules and procedures of the 2020 election shall be as follows:

1. Election of Officers and Executive Board Members of Local 793 shall be conducted as per Article XXIV, Subdivision 1, Section (b) of the Constitution, and Article XXVI, Section 1, (h) and (j) of the Constitution.
2. Notice of the upcoming election is enclosed.
3. Nominations shall be conducted by districts and sub-districts in June 2020.
4. Letters of acceptance from nominees shall be returned in stamped self-addressed envelopes to the Recording-Corresponding Secretary of Local 793 within ten (10) days after having been notified by the Recording-Corresponding Secretary of their nomination to Local Union office. Letters of acceptance shall be opened by the Recording-Corresponding Secretary by Monday, July 20, 2020, in the presence of members of the Election Committee. This will be the only accepted method.
5. The election shall be by mail referendum conducted by a secret ballot.
6. Elections shall be conducted by the Election Committee.
7. The Financial Secretary shall be responsible to provide a complete up-to-date list of all members eligible to receive a ballot by no later than Monday, July 20, 2020.
8. Ballots shall be mailed by Tuesday, August 4, 2020, and received no later than Wednesday, September 2, 2020, and shall be counted on Thursday, September 3, 2020.
9. Any candidate or their representative may be present at the counting of the ballots.
10. Each Committee Member shall receive a copy of all incoming correspondence pertaining to the election.
11. No member shall be in good standing unless they have paid all current dues to the Local in the month in which they are due and all current years’ assessments are paid in full no later than June 30, 2020.
12. Members’ names identified on the June 2020 suspension list (unless identified by error) shall not be eligible to receive a ballot.
13. Any member may contact the Election Committee by writing to the Election Committee Secretary, IUOE, Local 793, 2245 Speers Road, Oakville, Ont., L6L 6X8.

NOMINATION SAFETY MEASURES

In order to facilitate the nomination process for the upcoming election while maintaining the members’ health and safety during the COVID-19 pandemic, the following safety measures have been implemented:

1. Members who wish to cast their nomination shall attend their respective area offices and must line up outside said office with a minimum separation of 2 metres between each individual in line (temporary chalk markers shall be outlined on the pavement to ensure mandated social distancing protocols are followed);

2. Only one member shall be permitted inside the office at a time to cast their nomination;

3. IUOE Local 793 staff shall have a check point set up at the entrance to the building wherein all members must have their temperatures taken prior to being granted entry to the building (any member who is screened positive for a fever will not be permitted entry);

4. Thermometers used to screen members shall be contactless, meaning temperatures will be taken from a safe distance;

5. This same staff shall ask each member screening questions to ensure they do not pose a risk to other members/staff. This includes “Have you been tested positive for COVID-19? Are you experiencing any symptoms of illness, including even minor cold/flu symptoms? Have you recently travelled? Have you been in contact with anyone else who has tested positive for COVID-19, displayed symptoms of illness, or recently travelled?” If a member answers yes to any of these questions they will not be permitted entry to the building.

6. Each member must use a pump of hand sanitizer prior to entering the building, and another upon exiting the building, to prevent cross contamination;

7. Each member shall be provided their own pen to use when completing the nomination in order to prevent cross contamination;

8. A self-seal express post envelope shall be available in the office for the members to place their own nomination into without requiring contact;

9. Since studies have shown that COVID-19 can survive on cardboard for 24hours, the nominations shall remain sealed in the express post envelope for a minimum of 24hours after nominations, in order to prevent contamination during processing;

10. All staff present to assist members and screen members prior to entry shall be equipped with masks and gloves;

11. If any member does not feel comfortable entering the building to cast their nomination, they shall be provided a nomination form outside the building and allowed to cast their nomination outside.

OAKVILLE – Local 793 of the International Union of Operating Engineers, one of Ontario’s largest construction unions, is extremely disappointed with the Ontario Government’s wrongful decision to cancel the procurement for the Halton Region Consolidated Courthouse project and asks that the decision be reversed.

“IUOE Local 793 calls on the Ford Government to reconsider the project right away and invest in the infrastructure and jobs that are a vitally needed shot-in-the-arm stimulus for our economy,” Local 793 Business Manager Mike Gallagher said.

Scheduled to begin construction in early June, the shovel-ready project would have an immediate beneficial impact by creating jobs and stimulating the province’s economy during the COVID-19 pandemic.

“One could, in the face of uncertainty, find some hope that our government could agree that projects like the $500 million-plus Halton Courthouse would not only realize all political party recognition of the need for justice facilities in one of the fastest growing communities in Canada, but which timing is perfect to help get jobs moving again,” Gallagher said.

He stated that the cancellation will only begin to undermine confidence in the province’s infrastructure program at a time when the government wants to get the economy going.

“Canada and Ontario are not some backwater jurisdiction that replaces years of planning and a job tendering process with knee-jerk decisions that make us appear to be so unreliable that no contractors could waste their time and energy on bidding jobs here,” Gallagher warned.

The decades-old Milton courthouse has been facing challenges for years. Progressive Conservative MPP Ted Arnott delivered a message in the Ontario Legislature in 2015, stating it was time for the government to commit to building a new Halton courthouse. “The current Halton Courthouse is aging, overcrowded, unsafe, and inadequate to meet the needs of our rapidly growing region.”

Ontario Superior Court Justice Peter Daley said on November 19, 2018: “In excess of $2 million has been spent on mould remediation at the Milton Courthouse thus far, with an additional $600,000 forecasted to be spent on further mould remediation.”

Building a new courthouse is an expensive endeavor but given the age and physical condition of the Milton courthouse, no plan to renovate or expand the facility will address these issues.

The provincial government said it will direct its resources for the courthouse project toward developing ways of delivering justice remotely and online, which will raise concerns over privacy and transparency.

“It is unfathomable that the Attorney General’s office would cancel the hundreds of jobs needed and a project two years in the planning with the absolutely ridiculous notion that ‘virtual justice’ could replace the real justice that courtrooms with juries, judges and the legal profession bring to ensure that justice is not denied,” Gallagher concluded.

Day of Mourning: Mourn for the Dead, Fight for the Living

This year’s Day of Mourning theme is “Mourn for the Dead, Fight for the Living.” The Canadian Labour Congress first recognized the Day of Mourning in 1984. This day became a national observance in 1990 and the federal government officially proclaimed the National Day of Mourning on April 28, 1991. Today, it is recognized in more than 100 countries. Local 793 asks members across the province to observe a moment of silence at 11:00 a.m. to remember the workers who have died, were injured, or made ill from their work. […]

Local 793 member Eric Wheeler of Beamsville, Ontario, died on May 6, 2019 due to compensable injuries suffered in a work-related accident. He was 32 years old.

Eric was initiated into IUOE local 955 out of Alberta in June 2011 and transferred to Local 793 in March 2015. He worked for Aquatech Dewatering Company and Arlington Crane Services in 2016 and for Limen Structures in 2017.

Too many workers are still being killed or injured on construction sites. More than 1,000 Canadians lose their lives in the workplace each year, with many more work-related deaths not accounted for. A significant number of workers are not covered by workers compensation, so there are many deaths and injuries that have not been recognized as work-related.

According to the Ministry of Labour, Training and Skills Development report from the IHSA Provincial Labour Management Committee, 16 people were killed in construction site accidents in Ontario in 2019 – down from 25 in 2018.

264 people were critically injured in construction site accidents in Ontario in 2019 – up from 255 in 2018.

The most recent statistics from the Association of Workers’ Compensation Boards of Canada (AWCBC) report that in 2018, 1,027 workplace fatalities were recorded in Canada – an increase of 76 from the previous year.

Add to these fatalities the 264,438 accepted claims for lost time due to a work-related injury or disease – an increase from 251,508 the previous year.

And it’s not just these numbers on which we need to reflect. With each worker tragedy there are loved ones, family members, friends and co-workers who are directly affected, left behind, and deeply impacted – their lives also forever changed.

These deaths are a reminder that all of us – labour, employers, government and health and safety partners – must do much more to improve safety in workplaces and on construction sites in Ontario. Too many workers go to work and then don’t return home to their families.

The Union’s relentless effort in getting members the COVID-19 Local 793 Emergency Relief grant has paid off.

That is the message Local 793 Business Manager Mike Gallagher delivers in his latest video update, and one of two good news items he shares with members.

Gallagher reports that the Union received confirmation from the federal government that payments from the COVID-19 Local 793 Emergency Relief program will not reduce or eliminate members’ entitlement to the Canada Emergency Response Benefit (CERB) and payments will not be clawed back.

OEBAC’s website will begin accepting applications for the grant on Thursday, April 23 at 9 AM.

Business Manager Gallagher also provides an update on a Supplemental Unemployment Benefits (SUB) plan that was passed by the Executive Board earlier this week.

Expected to be available in the fall, the SUB plan will provide additional financial assistance to unemployed members for years to come.

“I realize this is not a panacea for everything that ails us as far as occasional periods of unemployment, but it is a very good beginning,” Gallagher said.

1. What is the COVID-19 Local 793 Emergency Relief Grant Program?

The Benefit Trustees are committed to helping members deal with the many challenges caused by the COVID-19 pandemic. They worked with your benefit plan staff and legal advisors to introduce a relief grant program to provide special payments to eligible members over and above what the Canadian Emergency Response Benefit (CERB) offers through the federal government. The purpose of the relief grant payments is to provide additional financial benefits to members who are not able to work due to the COVID-19 pandemic.

2. How much relief grant money will I receive from the COVID-19 Local 793 Emergency Relief Grant Program?

You will receive up to $1,000 per 4-week period ($250 per week) for up to 16 weeks. This amount is taxable. This Relief Grant payment is in addition to the gross benefits you receive from the CERB.

3. When is the COVID-19 Local 793 Emergency Relief Grant Program effective?

The COVID-19 Local 793 Emergency Relief Grant Program is effective retroactive to March 15, 2020.

4. What are the conditions to get a payment from the COVID-19 Local 793 Emergency Relief Grant Program?

a) Your employment must have been disrupted due to the COVID-19 crisis on or after March 15, 2020.
b) You must be receiving benefits under the CERB.
c) You must have been eligible under the Active Life and Health Benefits Plan when your employment was disrupted.
Note: Dependants of Plan Members and Retirees are NOT eligible for the COVID-19 Local 793 Emergency Relief Grant Program.

5. How do you qualify for payments from the COVID-19 Local 793 Emergency Relief Grant Program?

To qualify for payments, you must provide proof that you are receiving payments from the CERB. You can do this by providing a copy of your CRA confirmation, CERB benefit cheque, or CERB direct deposit confirmation.

6. When and how do I apply for the COVID-19 Local 793 Emergency Relief Grant Program?

You can apply three (3) ways for the COVID-19 Local 793 Emergency Relief Grant Program:

1. Using online submission – go on the OEBAC website www.oebac.org and using the drop down box called COVID-19 Local 793 Emergency Relief Grant, enter the 793Portal.ca site. Once on the site you will follow instructions and enter the required information, and press submit. This is the fastest and most effective way to apply if you have an email address.

2. By email submission – go on the OEBAC website www.oebac.org and using the drop down box called COVID-19 Local 793 Emergency Relief Grant, enter the 793Portal.ca site. Once on the site, you can find a Benefit Claim that you can use to enter your information. This claim form and supporting documents can then be sent by email to covidapplications@oebac.org

3. By mail – go on the OEBAC website www.oebac.org and using the drop down box called COVID-19 Local 793 Emergency Relief Grant, enter the 793Portal.ca site. Once on the site, you can find a Benefit Claim form that you can print (or have someone print it for you). Fill in your information on this claim form and mail it to OEBAC at the following address:

7. When can I get the application for the COVID-19 Local 793 Emergency Relief Grant Program?

Claim forms will be available on the OEBAC website on Thursday April 23, 2020 at 9:00am.

9. What information will I need to complete the COVID-19 Local 793 Emergency Relief Grant Claim Form?

To complete the Claim Form, the following information is required:
• Name
• Certificate number
Banking information
• Evidence that you are in receipt of payments from the CERB (see question 5 above)
• Dates your employment was disrupted by COVID-19
• Name of employer
• Collective Agreement
• Your type of equipment

10. How do I send documentation to OEBAC to support my application for payments from the COVID-19 Local 793 Emergency Relief Grant Program?

You will be able to upload supporting documentation directly into our new 793Portal.ca site at www.oebac.org/how-apply.

If you do not have an email address, you will need to mail in your documents to OEBAC.
You can also send your claim form and any supporting documentation to covidapplications@oebac.org.

11. Are the relief grant payments from the COVID-19 Local 793 Emergency Relief Grant Program considered taxable income?

Yes. The relief grant payments are taxable and you will receive a T4A in 2021 for them.

12. Do I need to report the COVID-19 Local 793 Relief Grant payments as “income” when reapplying for the CERB?

Yes. Your Relief Grant payments are considered taxable income. However, the government has changed the CERB program such that you can earn up $1,000 (before taxes) or less during a 4-week eligibility period in addition to the CERB payment. As such the $1,000 that the COVID-19 Local 793 Relief Grant Program will pay you every 4 weeks will not affect your benefit from the CERB and there will be no claw back.

13. When will the relief grant payments from the COVID-19 Local 793 Emergency Relief Grant Program be made?

We have now received confirmation from the federal government that payments from the COVID-19 Local 793 Emergency Relief Grant Program will not reduce or eliminate your entitlement to CERB if your total income with the relief grant is less than $1,000 per month Therefore, OEBAC will start accepting your applications for the Relief Grant on April 23, 2020. Relief grant payments will be deposited into your bank account within 3 to 5 business days of your completed application being approved. Please understand there may be delays in the first few weeks as we expect large volumes of applications.

14. How often can I apply for a grant payment from the COVID-19 Local 793 Emergency Relief Grant?

You must reapply monthly (every 4 weeks) to get the COVID-19 Local 793 Emergency Relief Grant payment. This process coincides with the government CERB payments that you must also reapply for every 4 weeks.

15. How often will grant payments from the COVID-19 Local 793 Emergency Relief Grant be made?

Payments will be made to align with the government CERB payments. At this time, this is once for every 4-week period.

16. Can I get my relief grant payments from COVID-19 Local 793 Emergency Relief Grant by cheque?

No. The Relief Grant Program will only make payments by direct deposit into your bank account. In order to receive a payment, you are required to provide your banking information when you complete your claim form.

17. If I was off work (i.e. diagnosed with COVID-19 or in self isolation) and then go back to work, am I still eligible for a payment from the COVID-19 Local 793 Emergency Relief Grant Program?

Yes. The program is effective for all periods of lost income resulting from loss of employment from March 15, 2020 up to a maximum of 16 weeks.

18. What do I need to do to ensure continuation of payments from the COVID-19 Local 793 Emergency Relief Grant Program?

Members will be required to provide OEBAC with regular monthly confirmation that they are still out of work and in receipt of a CERB payment in order to continue receiving the Relief Grant payments. OEBAC will be auditing member documentation and reviewing employer remittances to ensure continued eligibility compliance. Confirmation of CERB payments can be provided through the 793Portal.ca site or by email to covidapplications@oebac.org.

19. What If I am receiving a pension and working when I get laid off, am I eligible for a payment from the COVID-19 Local 793 Emergency Relief Grant Program?

No. If you are receiving a pension from the IUOE Local 793 Pension Plan, you are not eligible for this benefit. This benefit is for active members who lose their jobs due to the COVID-19 pandemic.

20. I am a retiree and got diagnosed with COVID-19. Can I apply for the COVID-19 Local 793 Emergency Relief Grant Program?

No. This benefit is only for active members who lose their jobs due to the COVID-19 pandemic.

21. Can I go back to work and continue to receive a payment from the COVID-19 Local 793 Emergency Relief Grant Program?

No. The relief grant payments are only paid to active members who are not working due to the COVID-19 pandemic. Fraudulent claims for payment from this benefit program will be investigated and members caught making false claims will be penalized. The funds used to pay these benefits come from members and are for assisting our members who have lost their jobs.

22. Do I qualify for COVID-19 Local 793 Emergency Relief Grant Program if I am already receiving EI Regular or Sickness Benefits as of March 15, 2020?

If you are receiving EI benefits, you should continue to report to Service Canada as normal. You will not be eligible for the COVID-19 Local 793 Emergency Relief Grant Program. If your EI benefits end before October 3, 2020, you can apply for the CERB, if you are still unable to return to work due to COVID-19. Once you are in receipt of payments from CERB, you may apply for the COVID-19 Local 793 Emergency Relief Grant.

23. What do I do if I applied for EI Benefits after March 15, 2020 but have not yet received benefits?

Your EI application will automatically be funneled into the new CERB program and your CERB payments will be processed.

Once your CERB payment begins, you should also apply for the COVID-19 Local 793 Emergency Relief Grant Program.

24. Can I apply for the CERB if I don’t qualify for EI Regular and Sickness Benefits?

Yes. If you do not qualify for EI Benefits, you can still apply for the CERB on the CRA portal. Please note the federal government recommends that you should apply based on the month of your birth, as noted below.

o Month of Birth (Jan, Feb, Mar) – apply on Mondays
o Month of Birth (Apr, May, Jun) – apply on Tuesdays
o Month of Birth (Jul, Aug, Sep) – apply on Wednesdays
o Month of Birth (Oct, Nov, Dec) – apply on Thursdays
o Anyone can apply on Fridays
